The Securities Appellate Tribunal (SAT) has directed businessman Malvinder Mohan Singh and Malav Holdings to deposit 50 per cent of the penalty amount imposed by markets regulator Sebi within six weeks in connection with violations in a case related to Fortis Healthcare.

If they deposit the amount, then the market regulator will not collect the remaining penalty during the pendency of the appeal, the appellate tribunal said in its order. The amount deposited by the appellants will be kept in an interest bearing account and would be subject to the result of the appeal, it added.

The order came after Singh and others approached SAT against the capital markets regulator’s order passed in April, whereby it had slapped a fine of Rs 5 crore on Singh, who was the promoter of Fortis Healthcare, besides Rs 2.5 crore each on Malav Holdings, a company owned by Singh, and Gagandeep Singh Bedi, who was the chief financial officer of Fortis Healthcare.

In addition, Sebi had barred Malvinder Mohan Singh and his brother Shivinder Mohan Singh from the securities market for a period of three years. They have also been restrained from being associated as directors or key managerial personnel in a listed company or Sebi-registered intermediary of any market infrastructure institution.

The case relates to the Singh brothers, along with other entities, allegedly diverting funds from Fortis Healthcare for the ultimate benefit of RHC Holding Pvt Ltd — an entity indirectly owned and directly controlled by the erstwhile promoters. These entities acted in a fraudulent and deceptive manner which led to misuse and/or diversion of funds to the tune of Rs 397.12 crore for the ultimate benefit of RHC Holding, as per the order.

It was also alleged that Gagandeep Singh Bedi deliberately failed to carry out adequate due diligence and exercise independent judgement. In an order passed on Monday, SAT directed “the appellant Malvinder Mohan Singh, noticee no.2 and Malav Holdings P. Ltd., noticee no.4 each deposit 50 percent of the penalty amount within six weeks from today.” Bedi has been asked to deposit Rs 25 lakh within six weeks. August 1 is the next date of hearing.

Malvinder Mohan Singh’s counsel submitted before the appellate tribunal that Singh was not given adequate opportunity to contest the matter. It has been stated that the appellant is still in jail and that his advocate could not have access to him and could not receive adequate instructions.

The counsel further said it is not known as to how much penalty has been calculated under each head, adding that the penalty amount is excessive. Singh brothers are now not associated with Fortis Hospitals and Fortis Healthcare

Meanwhile, Aarti Industries, Anupam Rasayan India, Birla Corporation, Dalmia Bharat, Ethos, Grasim Industries, IPCA Laboratories, JK Cement, Life Insurance Corporation of India (LIC), Panasonic Energy India Company, Shree Cement, Tasty Bite Eatables, Spicejet, Ultratech Cement, Vijaya Diagnostic Centre were among the scrips at fresh lows.

A total of 18 securities hot 52-week on NSE, while 47 stocks touched new lows intraday. Aether Industries, Elecon Engineering Company, HBL Power Systems, ICICI Prudential Mutual Fund – BHARAT 22 ETF, Khandwala Securities, Kohinoor Foods, Mukand Engineers, Nippon India Mutual Fund – ETF Nifty SDL – 2026 Maturity, Standard Industries were among the securities that hit 52-week high. Meawhile, Aarti Industries, Asian Hotels (West), Aptus Value Housing Finance India, Balaji Telefilms, Biocon, Debock Industries, Equitas Small Finance Bank, Hikal, Hindustan Petroleum Corporation, Isgec Heavy Engineering, Just Dial, Medico Remedies, Sanghi Industries, UTI Asset Management Company, Vertoz Advertising, Vindhya Telelinks were among the stocks at fresh lows.

Oil prices fell on Thursday on speculation that Saudi Arabia and other OPEC members may boost crude output to compensate for a drop in Russian production.

Brent crude was down $2.07, or 1.8%, at $114.22 a barrel at 0649 GMT, having risen 0.6% the previous day.

U.S. West Texas Intermediate (WTI) crude dropped $2.21, or 1.9%, to $113.05 a barrel, after a 0.5% rise on Wednesday.

The benchmarks have marched higher for several weeks as Russian exports have been squeezed by U.S. and EU sanctions against Moscow over its invasion of Ukraine, action Moscow calls a “special operation”.

The market has also seen support from China’s gradual emergence from strict COVID-19 lockdowns.

But oil prices fell on Thursday ahead of a meeting of Organization of Petroleum Exporting Countries and allies including Russia, known as OPEC+, during which the group will decide on an oil production policy for July.

Saudi Arabia and other OPEC members could boost oil output to offset a drop in Russian production, two OPEC+ sources said on Thursday.

Russian production has fallen by around 1 million barrels per day (bpd) on the back of sanctions.

One OPEC+ source familiar with the Russian position said Moscow could agree to other producers raising production to compensate for its lower output but not necessarily making up all the shortfall.

The Kremlin maintains it can re-route oil exports to minimise losses from EU sanctions, but analysts remain sceptical.

“The extent to which this will prove achievable is questionable, however. Russian oil production is therefore likely to fall again in the coming months,” said Commerzbank analyst Carsten Fritsch, who also questioned the ability of OPEC+ to add considerably more oil to the market.

As recently as Wednesday, sources expected OPEC+ to stick to its modest monthly increases in oil output, despite seeing tighter global markets.

An OPEC+ technical committee trimmed its forecast for the 2022 oil market surplus by about 500,000 bpd to 1.4 million bpd, two OPEC+ sources said.

The Wall Street Journal reported on Tuesday that some OPEC members were considering suspending Russia from the agreed production plan, to allow other producers to pump significantly more crude, as sought by the United States and European nations.

But two OPEC+ sources told Reuters a technical meeting on Wednesday had not discussed the idea. Six other OPEC+ delegates said the idea was not being discussed by the group.
